Government of the Russian Federation Resolution No. 1148 of December 31, 2009 - On the procedure for storing narcotic drugs, psychotropic substances and their precursors

In accordance with Article 20 of the Federal Law "On Narcotic Drugs and Psychotropic Substances", the Government of the Russian Federation decides:

1. Approve the attached:

Rules for the storage of narcotic drugs, psychotropic substances and their precursors;

changes that are being made to the acts of the Government of the Russian Federation regulating the circulation of narcotic drugs and psychotropic substances.

2. This Resolution shall enter into force upon the expiration of 90 days from the date of its official publication.

REGULATIONS

STORAGE OF NARCOTIC DRUGS, PSYCHOTROPIC SUBSTANCES

AND THEIR PRECURSORS

1. These Rules establish the procedure for the storage of narcotic drugs and psychotropic substances included in the list of narcotic drugs, psychotropic substances and their precursors subject to control in the Russian Federation, approved by Decree of the Government of the Russian Federation of June 30, 1998 N 681 (hereinafter - narcotic drugs and psychotropic substances), as well as precursors of narcotic drugs and psychotropic substances included in list I of the specified list (hereinafter - precursors).

2. The storage of narcotic drugs, psychotropic substances and precursors is carried out by legal entities licensed for activities related to the circulation of narcotic drugs, psychotropic substances and precursors, as well as with the right to store them (hereinafter - legal entities).

3. The storage of narcotic drugs, psychotropic substances and precursors is carried out in isolated rooms specially equipped with engineering and technical means of protection (hereinafter referred to as premises), as well as in places of temporary storage (with the exception of precursors).

4. The premises are divided into 4 categories. In relation to the premises of each category, basic requirements are established for their equipment with engineering and technical means of protection, as well as for the conditions for storing narcotic drugs, psychotropic substances and precursors in them.

The 1st category includes the premises of manufacturers and manufacturers (with the exception of pharmacies) of narcotic drugs, psychotropic substances and precursors, intended for storage of raw materials and finished products (except for products in work in progress), as well as premises of organizations engaged in wholesale trade in narcotic drugs, psychotropic substances and precursors and (or) the processing of narcotic drugs, psychotropic substances and precursors intended for the storage of narcotic drugs, psychotropic substances and precursors.

The third category includes the premises of health care institutions intended for storing a 5-day and (or) 3-day supply of narcotic drugs and psychotropic substances and narcotic drugs and psychotropic substances surrendered by relatives of deceased patients, premises of legal entities intended for storing narcotic drugs and psychotropic substances used for veterinary, scientific, educational and expert purposes, as well as precursors used for scientific, educational and expert purposes.

The 4th category includes the premises of health care institutions intended for storing the daily supply of narcotic drugs and psychotropic substances, as well as places for temporary storage of narcotic drugs and psychotropic substances used for medical purposes (ambulances and emergency medical care, posts of nurses of health care institutions , assistant rooms of pharmacies, first aid kits on sea, river, aircraft, on trains, etc.).

Stocks of narcotic drugs and psychotropic substances registered in the prescribed manner in the Russian Federation as medicines intended for medical use are determined by legal entities on the basis of the standards established by the Ministry of Health and Social Development of the Russian Federation for calculating the need for these medicines intended for medical use ...

Stocks of narcotic drugs and psychotropic substances registered in the Russian Federation as medicines for veterinary use in accordance with the established procedure are determined by legal entities on the basis of the standards established by the Ministry of Agriculture of the Russian Federation for calculating the need for these medicines for veterinary use.

5. A room belonging to the 1st category is equipped with a burglar alarm system, consisting of at least 3 lines of protection, and an alarm signaling with the output of signals to the centralized monitoring panel of the private security unit at the internal affairs body of the Russian Federation, and in the absence of an opportunity such a connection - with a signal output to the guard post.

Door and window structures of the premises provide reliable protection.

The doorway of the entrance to the premises is protected from the inside by an additional metal lattice door with a locking device, which has a protection class against destructive effects of at least 2, made of steel reinforcement. The design of the doorway is made of a steel profile.

Window structures have the 3rd class of protection against destructive influences. On the window structures from the inside or between the frames, metal gratings made of steel rods, or blinds or roller shutters, equivalent in strength to metal gratings, are installed.

Narcotic drugs, psychotropic substances and precursors are stored in lockable safes of at least class 4 burglary resistance or metal cabinets.

It is allowed to store narcotic drugs, psychotropic substances and precursors on racks (pallets) in an unopened (undamaged) group or shipping container or in a sealed container in case of storing large volumes of narcotic drugs, psychotropic substances and precursors that do not allow their placement in safes (metal cabinets) ...

6. A room belonging to the 2nd category is equipped with a burglar alarm system, consisting of at least 2 lines of protection, and an alarm system with signals output to the central monitoring console of a private security unit under the internal affairs body of the Russian Federation, and in the absence of an opportunity such a connection - with a signal output to the guard post.

The entrance door to the room can be metal, wooden (reinforced with upholstery on 2 sides with sheet metal or metal plates) or from another material that provides a class of protection against destructive effects of at least 3. The entrance door has at least 2 locking devices of the 3rd class of protection against destructive influences.

The doorway of the entrance to the premises is protected from the inside by an additional metal lattice door with a locking device, which has a protection class against destructive effects of at least 2, made of steel reinforcement.

On the window structures of the 1st and last floors, from the inside or between the frames, metal gratings made of steel rods, or blinds, equivalent in strength to metal gratings, are installed. Window structures must have a destructive impact protection class of at least 3.

Narcotic drugs and psychotropic substances are stored in lockable safes of at least class 4 burglary resistance or metal cabinets.

7. A room belonging to the 3rd category is equipped with an entrance metal door, a wooden door reinforced on 2 sides with sheet metal, or a door made of another material with a class of protection against destructive influences not lower than 3rd.

The entrance door has at least 2 locking devices of the 3rd class of protection against destructive influences.

Narcotic drugs, psychotropic substances and precursors are stored in lockable bulk safes or safes attached to the floor (wall) of at least class 3 burglary resistance. A safe weighing less than 1000 kilograms can be attached to the floor or wall, or built into the wall using an anchorage.

8. In a room belonging to the 4th category, narcotic drugs and psychotropic substances are stored in lockable bulk safes or safes attached to the floor (wall), not lower than 3rd class of resistance to burglary. A safe weighing less than 1000 kilograms is attached to the floor or wall, or built into the wall using an anchor.

In other places of temporary storage, narcotic drugs and psychotropic substances are stored in lockable safes of at least 1 class of resistance to burglary or metal containers or containers made of other high-strength materials.

9. Narcotic drugs and psychotropic substances stored in premises of all categories and in places of temporary storage are subject to accounting in accordance with the Rules for maintaining and storing special logs for registering transactions related to the circulation of narcotic drugs and psychotropic substances, approved by the Decree of the Government of the Russian Federation dated November 4, 2006 N 644.

The precursors stored in the premises of the 1st and 3rd categories are subject to accounting in accordance with the Rules for maintaining and storing special logs for registering operations related to the circulation of precursors of narcotic drugs and psychotropic substances, approved by the Decree of the Government of the Russian Federation of June 9, 2010 No. 419.

10. In order to ensure the safety of narcotic drugs, psychotropic substances and precursors, the premises are subject to protection.

The protection of premises belonging to the 1st and 2nd categories is carried out on a contractual basis by non-departmental security units under the internal affairs bodies of the Russian Federation, by an organization subordinate to the Ministry of Internal Affairs of the Russian Federation, or by departmental security of federal executive bodies.

The protection of premises belonging to the 3rd and 4th categories is carried out by involving the indicated security organizations, or legal entities licensed to carry out non-state (private) security activities.

11. The level of engineering and technical strength of the premises, the types of technical means of protection and the class of resistance to burglary of safes are determined when concluding an agreement with the security organization specified in paragraph 10 of these Rules.

12. After the end of the working day, safes, metal cabinets and rooms are sealed (sealed) and handed over under protection. Premises with round-the-clock operation are not subject to surrender.

13. By order of the head of the legal entity, persons responsible for the storage of narcotic drugs, psychotropic substances and precursors, admitted to work with narcotic drugs, psychotropic substances and precursors, are appointed, and the procedure for storing keys to safes, metal cabinets and premises, as well as used for sealing (sealing) seals and sealing devices.

The list of persons entitled to access the premises is approved by the order of the head of the legal entity.

14. Responsibility for organizing the storage of narcotic drugs, psychotropic substances and precursors rests with the head of a legal entity or an official authorized by him.

15. Special requirements for storage conditions:

narcotic drugs and psychotropic substances registered in accordance with the established procedure in the Russian Federation as medicines intended for medical use in pharmacies, medical institutions, research, educational organizations and wholesale drug trade organizations - established by the Ministry of Health and Social Development Russian Federation;

narcotic drugs and psychotropic substances registered in the prescribed manner in the Russian Federation as medicines for veterinary use in pharmacy and veterinary organizations - established by the Ministry of Agriculture of the Russian Federation.

16. The peculiarities of the storage of narcotic drugs and psychotropic substances intended to ensure activities in the system of federal security service bodies and the federal executive body in the field of internal affairs, as well as in the Armed Forces of the Russian Federation, are established by the relevant federal executive bodies.

1. Regulations on the Ministry of Health and Social Development of the Russian Federation, approved by the Decree of the Government of the Russian Federation of June 30, 2004 N 321 (Collected Legislation of the Russian Federation, 2004, N 28, Art. 2898; 2008, N 23, Art. 2713; 2009 , No. 2, Article 244; No. 3, Article 378; No. 33, Article 4083; No. 43, Article 5064; No. 45, Article 5350), supplemented with subparagraphs 5.2.100.88 and 5.2.100.89 of the following content:

In the Decree of the Government of the Russian Federation of November 4, 2006 N 648 "On approval of regulations on licensing activities related to the circulation of narcotic drugs and psychotropic substances" (Collected Legislation of the Russian Federation, 2006, N 46, Art. 4798; 2008, N 25, art. 2982):

in subparagraph "d" of paragraph 5 of the Regulations on the licensing of activities related to the circulation of narcotic drugs and psychotropic substances included in List II in accordance with the Federal Law "On narcotic drugs and psychotropic substances", approved by the said Resolution, the words "rules for the storage of narcotic drugs and psychotropic substances "shall be replaced with the words" of the Rules for the storage of narcotic drugs and psychotropic substances approved by the Decree of the Government of the Russian Federation of December 31, 2009 N 1148 ";

STORAGE RULES FOR NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES

1. These Rules establish the procedure for the storage of narcotic drugs and psychotropic substances included in the list of narcotic drugs, psychotropic substances and their precursors subject to control in the Russian Federation, approved by Decree of the Government of the Russian Federation of June 30, 1998 N 681 (hereinafter referred to as narcotic drugs and psychotropic substances).

2. The storage of narcotic drugs and psychotropic substances is carried out by legal entities that have a license for activities related to the circulation of narcotic drugs and psychotropic substances, as well as with the right to store them (hereinafter - legal entities).

3. The storage of narcotic drugs and psychotropic substances is carried out in isolated rooms specially equipped with engineering and technical means of protection (hereinafter referred to as premises), and in places of temporary storage.

4. The premises are divided into 4 categories. In relation to the premises of each category, basic requirements are established for their equipment with engineering and technical means of protection, as well as for the conditions for storing narcotic drugs and psychotropic substances in them.

The 1st category includes the premises of manufacturers and manufacturers (with the exception of pharmacies) of narcotic drugs and psychotropic substances intended for storage of raw materials and finished products (with the exception of products in work in progress), as well as premises of organizations engaged in wholesale trade in narcotic drugs. drugs and psychotropic substances and (or) processing of narcotic drugs and psychotropic substances intended for the storage of narcotic drugs and psychotropic substances.

The 3rd category includes the premises of health care institutions intended for storing a 5-day and (or) 3-day supply of narcotic drugs and psychotropic substances and narcotic drugs and psychotropic substances surrendered by relatives of deceased patients, as well as premises of legal entities intended for storage narcotic drugs and psychotropic substances used for veterinary, scientific, educational and expert purposes.

The 4th category includes the premises of health care institutions intended for storing the daily supply of narcotic drugs and psychotropic substances, as well as places for temporary storage of narcotic drugs and psychotropic substances used for medical purposes (ambulances and emergency medical care, posts of nurses of health care institutions , assistant rooms of pharmacies, first aid kits on sea, river, aircraft, on trains, etc.).

Stocks of narcotic drugs and psychotropic substances registered in the Russian Federation as medicines intended for animals are determined by legal entities on the basis of the standards established by the Ministry of Agriculture of the Russian Federation for calculating the need for these medicines intended for animals.

5. A room belonging to the 1st category is equipped with a burglar alarm system, consisting of at least 3 lines of protection, and an alarm signaling with a signal output to the centralized monitoring panel of a private security police unit under the internal affairs body of the Russian Federation, and in the absence of the possibility of such a connection - with a signal output to the guard post.

Door and window structures of the premises provide reliable protection.

The doorway of the entrance to the premises is protected from the inside by an additional metal lattice door with a locking device, which has a protection class against destructive effects of at least 2, made of steel reinforcement. The design of the doorway is made of a steel profile.

Window structures have the 3rd class of protection against destructive influences. On the window structures from the inside or between the frames, metal gratings made of steel rods, or blinds or roller shutters, equivalent in strength to metal gratings, are installed.

It is allowed to store narcotic drugs and psychotropic substances on racks (pallets) in an unopened (undamaged) group or transport container or in a sealed container in case of storing large volumes of narcotic drugs and psychotropic substances that do not allow their placement in safes (metal cabinets).

6. A room belonging to the 2nd category is equipped with a burglar alarm system, consisting of at least 2 lines of protection, and an alarm system with signals output to the central monitoring panel of the private security police unit under the internal affairs body of the Russian Federation, and in the absence of the possibility of such a connection - with a signal output to the guard post.

The entrance door to the room can be metal, wooden (reinforced with upholstery on 2 sides with sheet metal or metal plates) or from another material that provides a class of protection against destructive effects of at least 3. The entrance door has at least 2 locking devices of the 3rd class of protection against destructive influences.

The doorway of the entrance to the premises is protected from the inside by an additional metal lattice door with a locking device, which has a protection class against destructive effects of at least 2, made of steel reinforcement.

On the window structures of the 1st and last floors, from the inside or between the frames, metal gratings made of steel rods, or blinds, equivalent in strength to metal gratings, are installed. Window structures must have a destructive impact protection class of at least 3.

Narcotic drugs and psychotropic substances are stored in lockable safes of at least class 4 burglary resistance or metal cabinets.

7. A room belonging to the 3rd category is equipped with an entrance metal door, a wooden door reinforced on 2 sides with sheet metal, or a door made of another material with a class of protection against destructive influences not lower than 3rd.

The entrance door has at least 2 locking devices of the 3rd class of protection against destructive influences.

Narcotic drugs and psychotropic substances are stored in lockable bulk safes or safes attached to the floor (wall) of at least class 3 burglary resistance. A safe weighing less than 1000 kilograms is attached to the floor or wall, or built into the wall using an anchor.

8. In a room belonging to the 4th category, narcotic drugs and psychotropic substances are stored in lockable bulk safes or safes attached to the floor (wall), not lower than 3rd class of resistance to burglary. In other places of temporary storage, narcotic drugs and psychotropic substances are stored in lockable safes of at least 1 class of resistance to burglary or metal containers or containers made of other high-strength materials.

9. Narcotic drugs and psychotropic substances stored in premises of all categories and in places of temporary storage are subject to accounting in accordance with the Rules for maintaining and storing special logs for registering transactions related to the circulation of narcotic drugs, psychotropic substances and their precursors, approved by the Government Russian Federation dated November 4, 2006 N 644.

10. In order to ensure the safety of narcotic drugs and psychotropic substances, the premises are subject to protection.

The protection of premises belonging to the 1st and 2nd categories is carried out on a contractual basis by non-departmental security units under the internal affairs bodies of the Russian Federation, by an organization subordinate to the Ministry of Internal Affairs of the Russian Federation, or by departmental security of federal executive bodies.

The protection of premises belonging to the 3rd and 4th categories is carried out by involving the indicated security organizations, or legal entities licensed to carry out non-state (private) security activities.

11. The level of engineering and technical strength of the premises, the types of technical means of protection and the class of resistance to burglary of safes are determined when concluding an agreement with the security organization specified in paragraph 10 of these Rules.

16. The peculiarities of the storage of narcotic drugs and psychotropic substances intended to ensure activities in the system of federal security service bodies and the federal executive body in the field of internal affairs, as well as in the Armed Forces of the Russian Federation, are established by the relevant federal executive bodies. dated November 4, 2006 N 648 "On approval of regulations on licensing activities related to the circulation of narcotic drugs and psychotropic substances" (Collected Legislation of the Russian Federation, 2006, N 46, Art. 4798; 2008, N 25, Art. 2982):

Subparagraph "e" of clause 5 of the Regulation on licensing activities related to the circulation of narcotic drugs and psychotropic substances included in List I in accordance with the Federal Law "On narcotic drugs and psychotropic substances", approved by the decree of the Government of the Russian Federation dated April 7, 2008 . storage of narcotic drugs and psychotropic substances

1. These Rules establish the procedure for the storage of narcotic drugs and psychotropic substances included in the list of narcotic drugs, psychotropic substances and their precursors subject to control in the Russian Federation, approved by Decree of the Government of the Russian Federation No. 681 dated June 30, 1998 (hereinafter referred to as narcotic drugs and psychotropic substances).

2. The storage of narcotic drugs and psychotropic substances is carried out by legal entities that have a license for activities related to the circulation of narcotic drugs and psychotropic substances, as well as with the right to store them (hereinafter - legal entities).

3. The storage of narcotic drugs and psychotropic substances is carried out in isolated rooms specially equipped with engineering and technical means of protection (hereinafter referred to as premises), and in places of temporary storage.

4. The premises are divided into 4 categories. In relation to the premises of each category, basic requirements are established for their equipment with engineering and technical means of protection, as well as for the conditions for storing narcotic drugs and psychotropic substances in them.

The 1st category includes the premises of manufacturers and manufacturers (with the exception of pharmacies) of narcotic drugs and psychotropic substances intended for storage of raw materials and finished products (with the exception of products in work in progress), as well as premises of organizations engaged in wholesale trade in narcotic drugs. drugs and psychotropic substances and (or) processing of narcotic drugs and psychotropic substances intended for the storage of narcotic drugs and psychotropic substances.

The 2nd category includes the premises of pharmacies intended for storing a month's supply of narcotic drugs and psychotropic substances used for medical purposes.
The 3rd category includes the premises of health care institutions intended for storing a 5-day and (or) 3-day supply of narcotic drugs and psychotropic substances and narcotic drugs and psychotropic substances surrendered by relatives of deceased patients, as well as premises of legal entities intended for storage narcotic drugs and psychotropic substances used for veterinary, scientific, educational and expert purposes.

The 4th category includes the premises of health care institutions intended for storing the daily supply of narcotic drugs and psychotropic substances, as well as places for temporary storage of narcotic drugs and psychotropic substances used for medical purposes (ambulances and emergency medical care, posts of nurses of health care institutions , assistant rooms of pharmacies, first aid kits on sea, river, aircraft, on trains, etc.).

5. A room belonging to the 1st category is equipped with a burglar alarm system, consisting of at least 3 lines of protection, and an alarm signaling with a signal output to the centralized monitoring panel of a private security police unit under the internal affairs body of the Russian Federation, and in the absence of the possibility of such a connection - with a signal output to the guard post.

Door and window structures of the premises provide reliable protection.

The doorway of the entrance to the premises is protected from the inside by an additional metal lattice door with a locking device, which has a protection class against destructive effects of at least 2, made of steel reinforcement. The design of the doorway is made of a steel profile.

Window structures have the 3rd class of protection against destructive influences. On the window structures from the inside or between the frames, metal gratings made of steel rods, or blinds or roller shutters, equivalent in strength to metal gratings, are installed.

It is allowed to store narcotic drugs and psychotropic substances on racks (pallets) in an unopened (undamaged) group or transport container or in a sealed container in case of storing large volumes of narcotic drugs and psychotropic substances that do not allow their placement in safes (metal cabinets).

6. A room belonging to the 2nd category is equipped with a burglar alarm system, consisting of at least 2 lines of protection, and an alarm system with signals output to the central monitoring panel of the private security police unit under the internal affairs body of the Russian Federation, and in the absence of the possibility of such a connection - with a signal output to the guard post.

The entrance door to the room can be metal, wooden (reinforced with upholstery on 2 sides with sheet metal or metal plates) or from another material that provides a class of protection against destructive effects of at least 3. The entrance door has at least 2 locking devices of the 3rd class of protection against destructive influences.

The doorway of the entrance to the premises is protected from the inside by an additional metal lattice door with a locking device, which has a protection class against destructive effects of at least 2, made of steel reinforcement.

On the window structures of the 1st and last floors, from the inside or between the frames, metal gratings made of steel rods, or blinds, equivalent in strength to metal gratings, are installed. Window structures must have a destructive impact protection class of at least 3.

Narcotic drugs and psychotropic substances are stored in lockable safes of at least class 4 burglary resistance or metal cabinets.

7. A room belonging to the 3rd category is equipped with an entrance metal door, a wooden door reinforced on 2 sides with sheet metal, or a door made of another material with a class of protection against destructive influences not lower than 3rd.

The entrance door has at least 2 locking devices of the 3rd class of protection against destructive influences.

Narcotic drugs and psychotropic substances are stored in lockable bulk safes or safes attached to the floor (wall) of at least class 3 burglary resistance. A safe weighing less than 1000 kilograms is attached to the floor or wall, or built into the wall using an anchor.

8. In a room belonging to the 4th category, narcotic drugs and psychotropic substances are stored in lockable bulk safes or safes attached to the floor (wall), not lower than 3rd class of resistance to burglary. In other places of temporary storage, narcotic drugs and psychotropic substances are stored in lockable safes at least

Class 1 burglary resistance or containers made of metal or other high-strength materials.

9. Narcotic drugs and psychotropic substances stored in premises of all categories and in places of temporary storage are subject to accounting in accordance with the Rules for maintaining and storing special journals for registering transactions related to the circulation of narcotic drugs, psychotropic substances and their precursors, approved by the Government Russian Federation dated November 4, 2006 No. 644.

10. In order to ensure the safety of narcotic drugs and psychotropic substances, the premises are subject to protection.

The protection of premises belonging to the 1st and 2nd categories is carried out on a contractual basis by non-departmental security units under the internal affairs bodies of the Russian Federation, by an organization subordinate to the Ministry of Internal Affairs of the Russian Federation, or by departmental security of federal executive bodies.

The protection of premises belonging to the 3rd and 4th categories is carried out by involving the indicated security organizations, or legal entities licensed to carry out non-state (private) security activities.

11. The level of engineering and technical strength of the premises, the types of technical means of protection and the class of resistance to burglary of safes are determined when concluding an agreement with the security organization specified in paragraph 10 of these Rules.

12. After the end of the working day, safes, metal cabinets and rooms are sealed (sealed) and handed over under protection.

Premises with round-the-clock operation are not subject to surrender.

13. By the order of the head of the legal entity, persons are appointed responsible for the storage of narcotic drugs and psychotropic substances, admitted to work with narcotic drugs and psychotropic substances, and the procedure for storing keys to safes, metal cabinets and premises, as well as those used for sealing (sealing) seals is established. and sealing devices.

The list of persons entitled to access the premises is approved by the order of the head of the legal entity.

14. Responsibility for organizing the storage of narcotic drugs and psychotropic substances rests with the head of the legal entity or an official authorized by him.

15. Special requirements for storage conditions:

narcotic drugs and psychotropic substances registered in accordance with the established procedure in the Russian Federation as medicines intended for medical use in pharmacies, medical institutions, research, educational organizations and wholesale drug trade organizations - established by the Ministry of Health and Social Development Russian Federation;

narcotic drugs and psychotropic substances registered in the prescribed manner in the Russian Federation as medicines intended for animals in pharmacy and veterinary organizations - established by the Ministry of Agriculture of the Russian Federation.

16. The peculiarities of the storage of narcotic drugs and psychotropic substances intended to ensure activities in the system of federal security service bodies and the federal executive body in the field of internal affairs, as well as in the Armed Forces of the Russian Federation, are established by the relevant federal executive bodies.
