GENERAL DESCRIPTION OF WORK


Relevance of the topic dissertation research. The adoption of the Constitution of the Russian Federation of 1993 and concretizing its legislation did not immediately form in the country an effective mechanism for the implementation of state management functions in the conditions of separation of the authorities both vertically and horizontally. The Soviet administrative and commanding system of the country's management was actually eliminated, and the legal system was not yet created under workable form. The formation of a new Russian statehood of the end of the twentieth - early XXI centuries. It was characterized by a violation of a number of basic constitutional levels, the loss of the central authority to influence the political and socio-economic processes in the constituent entities of the Russian Federation and municipalities, the confrontation of representative, executive, judicial bodies of the public authorities at all its levels, and especially on the local. The investigation of this centrifugal, separatist aspirations of the constituent entities of the Russian Federation, the real threat to the territorial integrity of Russia, reducing the effectiveness of the territorial bodies of the federal executive authorities to address the urgent socio-economic problems and the emergence of the risk of active manifestation of mass discontent in the population, which imposed a significant imprint on the development of modern territorial territorial Control.

Public Administration and the system of public authorities in Russia since 2000 undergo significant changes that are largely related to the formation of seven federal districts and the creation of state bodies at the level of the Federal District. Currently, state administration at the level of the federal district is in the formation stage, is characterized by the intensive search for the central authority of the place of state bodies at the level of the federal district in the structure of the state apparatus and the mechanism of government. Some of these organs are only formed, and sometimes created are not valid enough. Improving the efficiency of state bodies at the level of the Federal District is the most important part of the administrative reform held today in Russia, and therefore, their functioning, as well as the existence of federal districts, is subject to consideration within the framework of administrative law. Optimization of public administration in the context of the implementation of administrative reform depends largely on the organizational and legal and institutional mechanisms of its incarnation at the level of the Federal District.

However, the proper integrated scientific study of public administration and state bodies at the level of the federal district, as well as federal districts as the management level has not yet been carried out. In existing publications, state bodies at the level of the federal district were considered fragmentary, which was the cause of the absence of an analysis of the effectiveness of these bodies in these works and solving the goals and objectives, as well as summarizing conclusions and specific proposals aimed at improving their legal statuses. There were no conceptual generalizations, answers to many questions put forward by practice. The problems of the organization and functioning of state bodies at the level of the Federal District, as a rule, were covered within the framework of the constitutional, not administrative law, and therefore the administrative and legal aspects of their activities remained unexplored.

The absence of a carefully developed theoretical basis significantly complicates the process of modernizing state bodies at the level of the federal district. In this regard, the most important task of science of administrative law today is a comprehensive study of public administration at the level of the federal district, understanding the regulation of various aspects of the activities of state bodies at the level of the federal district, as well as the introduction of the most effective forms of their organization and work into practice. In general, the need for a scientific study of public administration at the level of the Federal District is due not only to the importance of theoretical study of the issue of the place that occupies government agencies at the level of the federal district in the public administration system, but also more the need to summarize the experience of their functioning and proposing specific measures aimed at improving the effectiveness of administrative legal regulation of these bodies.

In general, in matters of institution and functioning of federal executive bodies at the level of the Federal District, a formal approach, imperfection and declarative of their legal framework are traced. The status of such bodies is often unreasonably understated, the activity is ineffective. The main problem is the lack of unification in the construction and legal status of state bodies at the level of the federal district. The second trend is largely predetermined first and is characterized by the creation at the level of the federal district of non-state structures.

3. Proves the existence of objective and subjective reasons that impede the strengthening and consolidation of the interaction and integration of state bodies at the level of the Federal District. Features of constructing, the uncertainty of the legal status and the hierarchical position of a number of government executive bodies at the level of the Federal District make it difficult to cooperate both between them and between other divisions of the federal executive bodies, the authorities of the President of the Russian Federation in the federal districts, the executive authorities of the constituent entities of the Russian Federation and the municipal Education, as well as non-state structures. Nevertheless, at the level of the federal district, they began to be created in some extent independent management and other structures with well-established mutual and multilateral connections.

4. It is argued that administrative reform implemented in the Russian Federation has largely selective, fragmented nature not only in relation to government agencies relating to various structures, but also to public administration levels. If its individual elements are held in the constituent entities of the Russian Federation and the municipalities, then at the level of the federal district, only the contours of the upcoming transformations were designated. The management effect associated with the establishment of territorial bodies of the federal executive bodies at the level of the federal district is not achieved due to the incompleteness of this process. In this regard, the necessity of the reform of the territorial administration is substantiated, which is to create and functioning the territorial bodies of federal executive bodies at the level of the Federal District while simultaneously liquidating (reorganization) of the territorial bodies of the federal executive bodies in the constituent entities of the Russian Federation. The formation of the territorial bodies of the federal executive bodies in the constituent entities of the Russian Federation is justified only if the unified executive system is not able to ensure the effective fulfillment of the powers of the Russian Federation in the field. The questions of the federal executive bodies at the level of the Federal District should be reflected in the Federal Law "On Administrative and Management Districts in the Russian Federation".

5. It is substantiated that the creation of governments of federal districts, giving Plenipotentiary representatives of the President of the Russian Federation in federal districts or special (authorized) representatives of the Government of the Russian Federation and their staff status of the administrations of federal districts with endowment of their executive and administrative powers and approval of budgets for each of the seven federal districts inexpedient . Otherwise, it will either lead to a violation of the principle of separation of the authorities or the departmental vertical of the executive authorities (the unity of the executive system), or can provoke separatism of federal districts. The terms of reference of the government of federal districts as presumably bodies of common competence, the mechanisms of interaction with the Government of the Russian Federation, the state authorities of the constituent entities of the Russian Federation and local governments, as well as the degree of subordination of the territorial bodies of the federal executive authorities both their central apparatus and federal governments districts. At the same time, the interaction of the central and territorial federal executive authorities with the executive authorities of the constituent entities of the Russian Federation and municipalities, and the federal state bodies entrusted with the responsibility for miscalculation in the field of regional development, admitted to state authorities of the constituent entities of the Russian Federation.

6. It is noted that the consolidation of the legal status of the Plenipotentiary Representatives of the President of the Russian Federation in federal districts by the norms of sub-banner legal acts is insufficient, not fully responsible for their significance. The provisions of the Federal Law "On Administrative and Management Districts in the Russian Federation" can fill this gap and consolidate the main elements of the legal status of the Plenipotentiary Representatives of the President of the Russian Federation in the federal districts, as well as identify key areas of their activities, the basis of interaction between them and with other public bodies, non-state structures. At the same time, it would be mistaken to completely abandon the practice of publishing regulatory legal acts regulating certain areas of the authorities of the President of the Russian Federation in federal districts and detailed federal law. Otherwise, the head of state will actually deprive the possibility of the operational modernization of its structures in the territorial level, is limited in the empower the formation of the Presidential Administration of the Russian Federation, the appointment and liberation of the Plenipotentiary Representatives of the President of the Russian Federation.

7. Proposals aimed at improving the legal status of Plenipotentiary Representatives of the President of the Russian Federation in federal districts, in particular on the establishment of additional conditions for the appointment of authorized representatives of the President of the Russian Federation in federal districts to the position. Such requirements can be formulated in the presidential presidential decree of 13.05.2000 No. 849 "On the authorized representative of the President of the Russian Federation in the Federal District" on the Plenipotentiary Representative of the President of the Russian Federation in the Federal District (hereinafter referred to as the Regulations on the Plenipotentiary) as follows: "Plenipotentiary A citizen of the Russian Federation, a citizen of the Russian Federation, who has no citizenship of a foreign state or a type of residence or other document, confirming the right to reside a citizen of the Russian Federation in a foreign state, can be appointed as a representative of the President of the Russian Federation in the Federal District, and a residence of a citizen of the Russian Federation on the territory of a foreign state and has reached the age of 30. 8. 9. It is concluded that the administrative reform in Russia should decide not only the problems of the organization and activities of the executive bodies. No less acute are the issues of improving the presidential structures, their interaction with other public bodies, civil society institutions, eliminating the duplication of functions within the head of the head of state. In this regard, it is necessary to optimize the apparatuses of authorized representatives of the President of the Russian Federation in federal districts, in particular, in the adoption of regulations of the Offices of Plenipotentiary Representatives of the President of the Russian Federation in federal districts; creation of commissions for compliance with the requirements for the official behavior of state civil servants of the Russian Federation and the settlement of the conflict of interest in the Offices of Plenipotentiary Representatives of the President of the Russian Federation in federal districts; Reorganization of the posts of the main federal inspectors and federal inspectors of the Offices of Plenipotentiary Representatives of the President of the Russian Federation in federal districts.

10. It is determined that the content of the tasks, functions and the rights of authorized representatives of the President of the Russian Federation in federal districts, as well as the mechanisms of their interaction with other public bodies and non-state structures due to the President of the Russian Federation in the system of separation of the authorities, its status and the meaning of the state, the guarantor of the Constitution The Russian Federation, human rights and freedoms and citizen, as well as an official holding a dominant position in the system of public administration authorities in the Russian Federation. As the head of state, the President of the Russian Federation is forced in some cases to make the functions of the executive power at its level. Similarly, the Plenipotentiary Representatives of the President of the Russian Federation in federal districts are often set before the same need at the local level due to the insufficient effectiveness of the executive authorities in modern Russia. The powers of the Plenipotentiary Representatives of the President of the Russian Federation in the federal districts are based on their concentrated on solving issues of strategic importance, ensuring national Security and have a polyfunctional orientation, and their legal status "secondary" in relation to the legal status of the President of the Russian Federation. At the same time, the administrative and legal status of the Plenipotentiary Representative of the President of the Russian Federation in the Southern Federal District is higher than the status of his colleagues, which is due to the need for a decision in the North Caucasus region of some problems in the field of state-building, which are not peculiar, at least on such scales for the rest of the territory countries. 11. It is established that the solution of the main tasks set by the head of state to the authorized representatives of the President of the Russian Federation in the federal districts, as well as the implementation of the functions assigned to them are difficult to determine, and in some cases impossible without participation in this process of other state bodies, local governments, public associations in this process. , organizations, citizens. In this regard, the activities of advisory and advisory bodies with the plenipotentists of the President of the Russian Federation in federal districts, which may be conditionally divided into three groups are important: bodies, the creation and activities of which are not necessarily provided for by federal legislation (established by the authorized representatives of the President of the Russian Federation in the federal counties at its own discretion); The authorities, the creation and activities of which are necessarily provided for by federal legislation (the discretion of the Plenipotentiary Representatives of the President of the Russian Federation in federal districts is excluded); The bodies of which are provided for by federal legislation, and the issues of activity are determined by the authorized representatives of the President of the Russian Federation in federal districts. They are a sphere (level) of management impact, spatial limits, in the boundaries of which state bodies implement the powers belonging to them. The constitutionality and feasibility of creating federal districts are substantiated. A comparative analysis of federal districts in Russia and similar formations in foreign countries, which showed their difference for a number of significant characteristics marked in dissertation.

It is noted that the federal districts are non-sectoral and non-functional formations, but are created to manage state affairs throughout their volume within the framework of federal competence. Analyzed the value of federal districts in the enhancement of the executive vertical of the authorities. It is concluded that the creation of federal districts should be considered in a broad sense as a transition from a two-link (federal center - subjects of the Russian Federation) to the three-star (federal center - federal districts - the subjects of the Russian Federation) the structure of the federal state territorial management. In a narrow sense, they act as the territorial sphere of the activities of the head of state, the formations in which the Plenipotentiary Representatives of the President of the Russian Federation at the interregional level ensure the implementation of the policy of the head of state in the field.

In the second paragraph, the state is highlighted and the location of federal districts in the system of other interregional entities in Russia is determined. The study of federal districts revealed their significant differences in a number of significant characteristics. It is noted that, despite the reduction in the subject line of Russia and changes in the names of some subjects of the Russian Federation, the list of federal districts under the content of changes has not been underwent. Since the centers of federal districts are not always those from a geographical point of view, enshrined today in the Regulations on the Plenipotentiary Representative "Plenipotentiary representative is placed in the center of the Federal District" requires clarification. It is proposed to state this rule as follows: "The plenipotentiary representative is placed in the relevant federal district in the place determined by the President of the Russian Federation, taking into account the proposals of the authorized representative and government bodies of the constituent entities of the Russian Federation located within the federal district. The place of placement of the plenipotentiary representative is the center of the Federal District. "

A comparative study of the federal districts and other interregional formations existing in Russia allowed the applicant to put forward a number of generalizations. In particular, it was concluded that, on the one hand, in contrast to other formations, federal districts contribute to the creation of real prerequisites for improving the effectiveness of centralized management of the country's socio-economic development and ensure the implementation of a strategy for building public administration at the interregional level. On the other hand, the federal districts, without performing an obstacle to the development of other interregorial entities, to the relevant placement of their placement and subject formulation, the established economic zoning of the country, the characteristics of the organization of basic sectors of the economy, transport infrastructure. This allows government agencies at the level of the Federal District to use experience gained by inter-dedicatorial formations, to carry out its functions based on the economic and partly of political ties have already been developed. It is indicated that the boundaries of federal districts were determined so as not to fully coincide with the boundaries of other interregional formations.

The third paragraph is devoted to the study of the significance of federal districts in the matter of changes in the state-territorial structure of the Russian Federation. The dissertation emphasizes that the arguments in justifying the need to consolidate the subjects of Russia more than enough. However, regarding the scheme of the consolidation of the constituent entities of the Russian Federation, the final result and the process of its flow, there is still no unity of opinion: they are largely controversial and ambiguous. It is justified that the current Constitution of the Russian Federation does not allow the full-scale change in the territorial division of the Russian state only by combining the constituent entities of the Russian Federation. In this case, it is indicated that the territorial transformations are likely to cause clarification of the limits of federal districts, their internal structure.

Stressing the important role of federal districts in the reform of the territorial structure of Russia, the applicant expresses the point of view of the unacceptability of the transformation of federal districts into the constituent entities of the Russian Federation and the consolidation of regions to the size of the existing federal districts. The actual substitution of the federal districts of the constituent entities of the Russian Federation will cause negative consequences designated by the author in thesis. If we are talking about the formation of several levels of constituent entities of the Russian Federation, a multi-level federation in Russia (in other words, federations in the federation) or on the creation within the boundaries of presumably new subjects of the Russian Federation - federal districts of peculiar "autonomies" in the form of existing subjects of Russia today, then for This will require the introduction of significant changes to the Constitution of the Russian Federation. In addition, a certain experience of the existence of a similar type of territorial division of the country has adversely established itself on the example of the so-called comprehensive subjects of Russia. The federal districts are invited to consider as a kind of alternative to the consolidation of constituent entities of the Russian Federation.

In the fourth paragraph, the modernization of the structure and system of federal districts in Russia in modern conditions was investigated. It is argued that the existing dimensions of federal districts entail a number of managerial problems associated with significant remoteness of their periphery. At the same time, in the process of forming federal districts, some of them were included in the subjects of the Russian Federation, the geographic location of which does not correspond to their name (for example, the location of the Perm Territory, the Orenburg region within the Volga Federal District, the Tyumen region, Khanty-Mansiysk (Ugra) and Yamalo -Nenetsky autonomous districts - within the Ural Federal District). In addition, some subjects of the Russian Federation are located in some federal districts and at the same time included in the composition of other territorial associations, geographically not coinciding with them. Objections causes the name "Central Federal District". The copyright understanding of the current situation is outlined.

The dissertation substantiates the feasibility of the institution in Russia of nine federal districts, which, in his opinion, will allow, not disturbing the interregional relations that have developed in the federal districts, align them among themselves in socio-economic terms, as well as strengthen the management aspect in their placement. A proposal is made to rename federal districts into the administrative and management districts, which, from the point of view of the applicant, will provide an opportunity to more accurately comprehend the essence of the districts as a management level, and reflect in their name administrative reform in their name. The state affiliation of the districts as administrative and management districts in the Russian Federation is determined.
